I. Relevant Security Council resolution and Committee Guidelines
The exemptions from the arms embargo are provided for by the following:
• Security Council Resolution 2752 (2024): paragraphs 2 (a), (b) and (c), and 6
• Committee Guidelines: Section 12
II. Who is entitled to submit the arms embargo exemption requests?
Permanent or Observer Mission of States to the United Nations, or the international, regional or subregional organization or agency supplying the equipment.
III. What type of arms embargo exemptions are currently in force?
There are two types of exemptions to the arms embargo:
• for the Committee’s consideration
• standing exemptions
1. Standing Arms Embargo exemptions
Pursuant to paragraphs 2(a) and 6 of resolution 2752 (2024), the following supplies, sales or transfers materials and recipients are exempt from the arms embargo. As such, no request or notification needs to be submitted to the Committee for its consideration or information.
• Arms and related materiel, or provision of related assistance, training, or personnel to or by the UN, including the United Nations Integrated Office in Haiti (BINUH) or an UN-authorized mission and to or by a security unit that operates under the command of the Government of Haiti, including the Multinational Security Support (MSS) mission authorized by resolution 2699 (2023), the Haitian National Police, and the Armed Forces of Haiti, intended to be used by or in coordination with those entities and intended solely to further the objectives of peace and stability in Haiti

• Non-lethal military equipment intended solely for humanitarian or protective use, and related technical assistance or training, when intended to further the objectives of peace and stability in Haiti
2. Arms embargo exemptions for the Committee’s consideration
Pursuant to paragraphs 2(b) of resolution 2752 (2024), the following supplies, sales or transfers are to be submitted for the Committee’s consideration in advance:
• Arms and related materiel, or provision of related assistance, training, or personnel to Haiti as approved in advance by the Committee established pursuant to resolution 2653 (2022) to further the objectives of peace and stability in Haiti
Pursuant to paragraphs 2(b) of resolution 2752 (2024), the following supplies, sales or transfers are to be submitted for the Committee’s consideration in advance:
• Arms and related materiel, or provision of related assistance, training, or personnel to Haiti as approved in advance by the Committee established pursuant to resolution 2653 (2022) to further the objectives of peace and stability in Haiti
IV. How to make a request for exemption from the arms embargo?

V. Decision Making of the Committee
The Chair will inform States in writing (usually through their Permanent or Observer Mission to the United Nations), international, regional or subregional organizations of the decision of the Committee regarding its consideration of exemption requests.
