I. Relevant Security Council resolutions
The exemptions to measures in relation to attempts to illicitly export petroleum, including crude oil and refined petroleum products, are provided for by the following:
- Security Council Resolution 2146 (2014): paragraphs 10 and 12, extended by paragraph 2 of resolution 2362 (2017)
II. Who is entitled to submit exemptions to measures in relation to attempts to illicitly export petroleum?
Member States who intend to allow the provision of bunkering services, such as provision of fuel or supplies, or other servicing of vessels, to designated vessels if it is necessary for humanitarian purposes, or in the case of return to Libya.
III. What are the exemptions to measures in relation to attempts to illicitly export petroleum, and how are they invoked?
Apart from exceptions which can be made by the Committee, there are two types of exemptions, one of which requires notification to the Committee:
Pursuant to paragraph 12 of resolution 2146 (2014), the Committee may make exceptions to some or all of the measures as may be necessary and appropriate.
Pursuant to paragraph 10 (b) of resolution 2146 (2014), States may allow the entry into ports if it is necessary for the purpose of an inspection, in the case of emergency or in the case of return to Libya. Member States may authorize the entry without notification to the Committee.
Pursuant to paragraph 10 (c) of resolution 2146 (2014), Member States may allow the provision of bunkering services, such as provision of fuel or supplies, or other servicing of vessels, to designated vessels if it is necessary for humanitarian purposes, or in the case of return to Libya. In this case, the Member State shall notify the Committee.

V. Decision Making of the Committee
Exceptions made by the Committee in accordance with paragraph 12 of resolution 2146 (2014) are subject to the Committee’s decision-making procedures, as outlined in paragraph 4(d) of the Committee’s Guidelines.
